Terms of Service

The short version

Use Embury for cocktails. Don't break the law with it. Your data is yours; the cocktail recipes we authored are licensed for your personal use. If you pay for Pro, we'll deliver it. If we mess up, we'll do our best. The boring legal stuff below covers everything else.

1. Acceptance

By using Embury — the website at embury.app, the installed PWA, or any associated services — you agree to these Terms of Service ("Terms"). If you don't agree, please don't use the app.

2. Who we are

3. The service

Embury is a cocktail spec book, recipe library, journal, resume builder, and AI-assisted cocktail toolkit for bartenders and bar professionals. We provide:

Some features are free; others are gated to Pro or Pro+AI subscription tiers.

4. Accounts

You can use Embury without an account (everything stored locally on your device). To enable sync and AI features, you create an account using an email and password. You're responsible for keeping your password confidential. If you suspect your account has been compromised, change your password and email us.

You must be at least 18 years old (or the legal drinking age in your jurisdiction, if higher) to use Embury.

You're responsible for your own bartending practice. Embury is a tool — not a substitute for training, judgment, or compliance with local laws on responsible alcohol service.

6. Your content

You own everything you create in Embury — your specs, journal entries, resume, signature drinks, photos, and notes. By using sync, you grant us a limited license to store and replicate your content across your devices and to display it back to you. We don't claim ownership of your work.

If you publish your resume or a cocktail to a public URL (e.g., embury.app/r/yourname), you grant us permission to host that public version until you unpublish it.

7. Our content

The cocktail specs and editorial content we authored — including recipe collections, encyclopedia entries, family essays, and the AI prompt designs — are protected by copyright. You may:

Where a recipe is attributed to a third party (Jerry Thomas, Dale DeGroff, Death & Co, etc.), that attribution is part of the integrity of the spec. Don't strip it.

8. AI features

AI features (resume import/restyle, cocktail builder, variations, menu writer) use Anthropic's Claude API to generate responses based on your input. AI outputs are:

The Resume AI Import explicitly refuses to invent work history, certifications, or awards from a freeform description. Use AI to expand and polish what's real, not to fabricate.

9. Paid subscriptions

Pro and Pro+AI subscriptions are billed monthly or annually via Stripe. By subscribing, you authorize Stripe to charge your payment method at the stated price plus any applicable taxes. Subscriptions auto-renew until you cancel.

10. Service availability

We aim for high uptime but make no SLA guarantees. The app works offline (PWA), so most features keep working even when our servers don't. Sync and AI features require a working connection to our backend.

We may modify or discontinue features at any time. For paid features, we'll either keep them running through your prepaid period or offer a prorated refund.

11. Termination

You can stop using Embury any time. To delete your account and all server-side data, email joe@lockworkstavern.com.

We may suspend or terminate accounts that violate these Terms (especially Section 5). For serious violations, we may do so without notice. For minor issues, we'll usually email first.

12. Disclaimer of warranties

Embury is provided "as is" and "as available." We make no warranty that the service will be uninterrupted, error-free, or meet your particular needs. The cocktail content is provided for informational purposes; you're responsible for your own service decisions, allergens, alcohol law compliance, and pour costs.

13. Limitation of liability

To the maximum extent permitted by law, Lockworks Tavern LLC is not liable for indirect, incidental, consequential, or punitive damages arising from your use of Embury. Our total liability for any direct damages is limited to the amount you paid us in the 12 months preceding the claim, or $100, whichever is greater.

14. Indemnification

You agree to indemnify and hold harmless Lockworks Tavern LLC from claims arising out of your misuse of the service, your violation of these Terms, or your violation of any law or third-party rights (including over-service liability if you use Embury in commercial bar operations).

15. Governing law

These Terms are governed by the laws of the State of Connecticut, United States, without regard to conflict-of-law principles. Any disputes will be resolved in the state or federal courts located in Connecticut.

16. Changes

We may update these Terms. For material changes, we'll notify signed-in users by email or in-app notice at least 14 days before they take effect. Continued use after changes constitutes acceptance.
